These Terms of Use govern your use of davidkeyes.com. By using the site, you agree to them. They are short on purpose.

01. Acceptance of terms

By accessing or using www.davidkeyes.com (the "Site"), you agree to these Terms of Use and to my Privacy Policy, which is part of these terms. If you do not agree, please do not use the Site. Your continued use after an update means you accept the revised terms.

02. Who I am

The Site is owned and operated by David Keyes, a creative director based in Los Angeles, California. In these terms, "I," "me," and "my" refer to David Keyes, and "you" refers to anyone who visits or uses the Site.

The Site is my portfolio and journal. It describes work I have done and how I think about it. Questions about these terms: hello@davidkeyes.com.

03. Using the Site

Permitted use

You may browse the Site, read its content, share links to it, and contact me through its forms, for lawful purposes.

What you may not do

  • Break any applicable law or regulation.
  • Scrape, harvest, or extract content or data from the Site with bots, crawlers, or other automated means without my written permission, including to train machine learning or AI models.
  • Attempt to gain unauthorized access to the Site or the systems behind it, or interfere with its security or performance.
  • Send spam, malware, or harmful code through the Site's forms.
  • Impersonate anyone or misrepresent your affiliation with anyone.

I may restrict or end access to the Site for anyone who breaks these terms.

04. Intellectual property and portfolio use

My content

Unless stated otherwise, the Site's copy, journal articles, layout, and original design elements (the "Site Content") are owned by David Keyes and protected by United States and international intellectual property laws.

Client work

The Site shows case studies, imagery, films, and other materials from work I performed for clients ("Client Work"). Client Work is shown solely for portfolio, illustrative, and self-promotional purposes. Ownership of Client Work, including the underlying products, brands, trademarks, and logos, remains with the respective clients and other rights holders, and nothing on the Site grants you any right to use it.

Many projects were made in collaboration with agencies, designers, developers, and production partners. Similar or identical work may therefore appear in their portfolios or on the client's own channels. Credits on each case study describe my role.

What you may do

You may quote short excerpts of the Site Content for non-commercial purposes with clear attribution to David Keyes and a link to the source, without modifying it. This permission does not extend to Client Work or third-party materials. Any other copying, reproduction, distribution, or derivative use requires written permission from the applicable rights holder.

05. Your submissions

When you send me a message or project details through the Site, you confirm you have the right to share them. I use them only to reply to you and to discuss potential work, as described in the Privacy Policy. I do not claim ownership of anything you send.

06. No professional relationship

Using the Site or contacting me does not create a client, employment, agency, or partnership relationship. Any engagement is governed only by a separate written agreement signed by both of us. Nothing on the Site is legal, financial, or professional advice.

07. Third-party links

The Site links to other websites, including client sites and social platforms, for convenience. I do not control them and am not responsible for their content, policies, or practices. Use them at your own risk.

08. Disclaimer

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. I do not promise the Site will be uninterrupted or error-free, and its content may be updated at any time without notice.

09. Limitation of liability

To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of or inability to use the Site, even if advised of the possibility of such damages. My total liability for any claim related to the Site will not exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow these limits, in which case they apply to the maximum extent the law allows.

10. Indemnification

You agree to indemnify and hold harmless David Keyes from any claims, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from your use of the Site, your violation of these terms, or your infringement of anyone else's rights.

11. Copyright complaints (DMCA)

If you believe content on the Site infringes your copyright, email hello@davidkeyes.com with the subject line "DMCA Notice" and include:

  • Your physical or electronic signature, as the owner or the owner's authorized agent.
  • The copyrighted work you believe is infringed.
  • The material on the Site you believe infringes it, and where it appears.
  • Your name, address, telephone number, and email address.
  • A statement that you believe in good faith the use is not authorized by the owner, its agent, or the law.
  • A statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.

I will review valid notices promptly and remove infringing material where appropriate. If you represent a client whose work appears on the Site and want it changed or removed, the same address reaches me directly.

12. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If you have a concern, please email me first at hello@davidkeyes.com; I will work in good faith to resolve it within 30 days. Any dispute that cannot be resolved informally will be heard exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

13. Privacy

How I handle personal information is described in the Privacy Policy at davidkeyes.com/privacy. California residents can also visit davidkeyes.com/do-not-sell.

I may update these terms from time to time. When I do, I will revise the "Last Updated" date above. The current version is always at davidkeyes.com/terms.

15. General

These terms and the Privacy Policy are the entire agreement between you and me about your use of the Site. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. My not enforcing a provision is not a waiver of it.
